A Virginia Beach woman who went to pick up a prescription for a pain medication says she ended up in jail instead.
Lisa Wynkoop, 35, claims in court documents that she was held for several hours after employees of a Walgreens accused her of prescription drug fraud. She filed a lawsuit against the drug store chain last week in Circuit Court. She’s seeking $475,000 in damages.
The filing states that in January 2018, Wynkoop submitted a prescription for Percocet that she’d gotten from her dentist to a Walgreens on Virginia Beach Boulevard, near Little Neck Road.
The store called the next day to inform her it was ready, but when she went to pick it up, she was told she’d need to wait for it to be finalized, the lawsuit claims. Police arrived a short time later and arrested her, charging her with attempting to obtain prescription drugs by fraud.
A store employee told pharmacy customers who witnessed the incident that “they caught another drug dealer,” the document claims.
Wynkoop spent eight hours in jail before she was able to get out on bail, the lawsuit says.
It was determined shortly after her release that the prescription was legitimate, the document says. Court records show that the charge was dismissed by prosecutors six weeks later.
Wynkoop’s lawyer, Greg Klein, declined to provide any more details about the case. A spokesman for Walgreens said the company doesn’t comment on pending litigation.
