Security guard justified in fatal shooting at Cedarwood Towers, grand jury rules
Rochester NY June 22 2019
A security guard will not face any criminal charges after a Monroe County grand jury determined his actions were justified in the fatal shooting of a man in early January.
The licensed security guard was justified when he shot and killed Bradley Thomas, 26, in the parking lot of the Cedarwood Towers on East Main Street on Jan. 8, 2019, the Monroe County District Attorney’s Office announced Thursday.
The DA’s office declined to name the security guard. After the investigation and presentation to the grand jury, “It was determined that Mr. Thomas was acting in a manic state, harassing others and threatened the defendant.”
Thomas lived in the building. He was threatening other residents in the lobby of the building when the security guard intervened. Police said he got in a scuffle with the on-duty security guard.
The security guard made multiple calls to 911 to report the situation and request help, prosecutors said. Police didn’t immediately respond, and the altercation spilled into the parking lot, where it escalated into a physical confrontation.
The security guard fired his legally registered firearm once at Thomas and struck Thomas in the upper body. Thomas was transported to Strong Memorial Hospital by American Medical Response, where he later died from his injuries.
