NYC Armored-Car Drivers Win Appeal for Overtime Under State Law

A labor dispute alleging money owed to armored truck guards is over after a court made a ruling.
The armored-truck company must pay its drivers overtime wages under New York law even though the Fair Labor Standards Act exempts them, the Second Circuit ruled Friday.
The New York Labor Law plainly states that employees subject to the FLSA’s motor carrier exemption must still receive overtime pay, just at a different pay rate, the U.S. Court of Appeals for the Second Circuit said in the per curiam decision.
Travis Hayward sued employer IBI Armored Services Inc., which operates in New York City, on behalf of a collective, alleging various wage violations of the FLSA and New York law.
