H&M Retail Workers’ Security-Check Class Survives Extra Scrutiny
California January 2 2020 A group of California-based retail workers who claim that H&M owes them wages for time spent undergoing security screenings have enough evidence to support class status, a California federal court ruled.
The U.S. District Court for the Northern District of California denied H&M’s post-discovery motion to decertify the class, which comprises nearly 11,000 H&M retail workers and was certified in 2018.
The retail workers sued H&M under California wage law seeking compensation for time spent undergoing personal bag checks and visual inspections of their person before leaving the store at the end of their shifts.
The court ruling allows the employees, current and former to proceed to a civil trial.
