Man shot by Cleveland security guard now facing charges in the incident
Cleveland OH October 24, 2023 A 34-year-old man pleaded not guilty to felonious assault after allegedly trying to run over a security officer at a gas station on Cleveland’s West Side earlier this year.
The alleged assault happened at Hanini’s Petroleum at West 73rd and Lorain Avenue on July 28.
As David Lowe pulled out of the gas station, one of the three security guards fired twice, hitting Lowe in the head, after the security guard claimed Lowe tried to run him over.
The injury caused Lowe to lose his eye.
“David inadvertently nearly hits the other security guard, who then takes that as an additional threat and then responds with unnecessary violence in the form of two shots to David’s head,” said Lowe’s attorney, Justin Weatherly.
The security guards are not facing charges in the case and Lowe’s attorney promises to take his client’s case to trial.
“The security that claimed Mr, Lowe was trying to run him over,” said Weatherly. “Mr. Lowe never saw him. And you cannot or that you never knew was there.”
David Lowe next appears before a judge Tuesday his 9:00 a.m. in front of Judge Peter Corrigan.
