Overton Security Services Inc. alleged to have failed to pay overtime wages
SAN DIEGO CA June 17 2017 – A California man employed as a security guard alleges he is owed unpaid wages.
Demario McMillian filed a complaint on behalf of all others similarly situated on June 9 in the U.S. District Court for the Northern District of California against Overton Security Services Inc. alleging violation of the Fair Labor Standards Act and other counts.
According to the complaint, the plaintiff has worked for the defendants since January as a security guard. The plaintiff holds Overton Security Services Inc. responsible because the defendant allegedly failed to pay overtime wages, failed to provide an itemized wage statement, failed to pay a minimum wage and failed to provide rest and meal breaks.
The plaintiff requests a trial by jury and seeks all unpaid wages, interest, compensatory damages, restitution, all legal fees and any other relief as this court deems just. He is represented by Carolyn Hunt Cottrell and David C. Leimbach of Schneider Wallace Cottrell Konecky Wotkyns LLP in Emeryville.
